TERMS OF SERVICE · OWNER REVIEW
Terms for the Vivatri pilot.
This draft is not approved service terms. An effective date, version, verified contact route and remaining legal decisions are needed before publication.
1. Who provides Vivatri
Vivatri is an application operated by Olivia Hanson. It provides tools for venues and performers to host games and for players to join them. A public support and privacy contact is still being prepared.
2. Pilot access and accounts
Vivatri offers Trivia, Bingo, Majority Rules and Always-On Trivia. Availability depends on the game, invitation, account role, venue membership and Host permissions. A game code identifies a match; it does not grant venue administration. A listing or profile does not guarantee a booking, audience, revenue or prize.
Online subscription checkout is unavailable. The planned prices on the Pricing page are informational. A pilot request or free account does not authorize a charge or conversion to paid access.
3. Account safety
Keep your password private. Vivatri sends signup verification and requested password-recovery links to your account address. The Help page explains email password reset. Organisation representatives must have authority to manage the relevant venue or performer access.
4. Responsible use and hosting
Do not impersonate others, harass people, submit content you cannot use, manipulate game results or rewards, attempt unauthorized access, or interfere with the service. Hosts and venues are responsible for their events, participation rules, prizes they independently offer, and applicable venue, safety, accessibility and licensing obligations.
5. Your content and game results
You retain the rights you hold in content you submit. This draft proposes a limited permission for Olivia Hanson to store, process and show that content to the audiences you select as needed to operate the feature. The scope and duration require final review. In-app Credits, levels and badges are game features; they do not by themselves promise cash or a prize. A Host offering a separate prize must explain its rules before play.
6. Availability and account closure
Connection problems, maintenance, event settings and pilot changes can affect availability. An account-closure and privacy-request process still needs a verified contact route. The current app does not offer an automated deletion request. Suspension and any paid-plan consequences need final rules and a tested review path.
7. Future paid subscriptions
The intended monthly policy lets a subscriber cancel the next renewal while keeping access through the period already paid. There is no automatic prorated refund for unused time; support may offer a discretionary refund, and applicable legal rights remain. The email-enabled launch will send a retainable cancellation confirmation. The provider, verified email delivery, exact cutoff, taxes, renewal rules and working cancellation route must be established before this becomes a paid agreement.
8. Service and event disclaimers
Vivatri is provided on an “as available” basis. We work to keep games, accounts and displays reliable, but cannot promise uninterrupted service, error-free results or that a particular device or connection will work. To the extent permitted by law, we make no additional warranties about the service. Venue events, admission, food, prizes and on-site safety are provided or managed by the relevant venue or host, not by Vivatri, unless we expressly say otherwise.
9. Limits on liability
To the extent permitted by applicable law, Olivia Hanson and Vivatri are not responsible for indirect or consequential losses, including lost profits, business opportunities or data, arising from use of the service. For a claim about the service, our total liability is limited to the greater of the amount you paid Vivatri for the affected service during the 12 months before the claim or CAD $100. This limit does not apply to liability that the law does not allow us to exclude or limit, including liability for fraud, wilful misconduct, or injury caused by negligence where a limit is prohibited. These terms do not reduce mandatory consumer rights or legal remedies.
10. Host responsibility
Venues and hosts remain responsible for their own events, staff, premises, announcements, prizes and content. If you operate a venue or host an event, you agree to address claims arising from those activities or from content you submit, except to the extent a claim results from Vivatri’s own conduct. Any final indemnity wording for business accounts requires legal review before publication.
11. Changes, disputes and concerns
We will identify the effective date and give notice of material changes before approved terms take effect. If part of these terms cannot be enforced, the rest can continue where legally permitted. Governing law, dispute process, age requirements and a verified contact route remain under owner and legal review. Nothing in a final version should remove rights or remedies required by applicable law.
